(c) “Item” means any item listed for sale on the Flimo

(e) “Website” means the Flimo Website under the domain
name “www.flimo.com.au”.
(f) “You” and “Users” includes Sellers and
Buyers and any persons accessing the Flimo Website.
(g) “Seller” means the Seller and any director, proprietor,
trustee and any other person responsible for the Seller where the
Seller is a company, business or trust or any other entity.
2. Information We Collect
(a) We only collect Personal Information that we consider necessary
to provide you with smooth and efficient transactions through the
Flimo Website.
(b) We may require the following additional information from sellers,
such as but not limited to:
(i) credit card information
(ii) name
(iii) address
(iv) email address
(v) other contact information.
(c) Information we collect from Sellers will be used for the purposes
of providing you with efficient services with respect to advertising
your Item.
(d) We will also use, and you hereby authorise us to use, your personal
information to improve our marketing and promotional efforts, to analyse
the Website usage, to improve the Website layout, content and products
and services.
(e) Upon becoming a member or upon listing an Item for sale, you will
be given the option to opt out of receiving communications from us
regarding your advertisement, promotional information and other communications
relevant to your use of the Flimo Website.
(f) You may opt out of receiving communications from us at any time.
3. Disclosure of Your Information
(a) We cannot and do not guarantee that all of your private communications
and other personal information will not be disclosed in ways other
than outlined in this Privacy Policy, due to technical limitations.
(b) You acknowledge that third parties may unlawfully intercept or
access transmissions or private communications from the Flimo Website
and thus your personal information provided to us may not always remain
private. You hereby indemnify and forever hold Flimo harmless from
and against third parties unlawfully obtaining your Private Information
from the Flimo Website.
(c) We will not sell any of your personal information to any third

(d) Our Website is set up so that Sellers and Buyers may have direct
contact with each other with respect to an Item or Advertisement.
By listing an Item on our Website or by contacting a Seller, you authorise
those persons to have access to your personal information. You hereby
acknowledge and agree that we cannot restrain any party from giving
out your personal information and you agree that Flimo is not liable
for any loss or damage (whether personal or financial) you may suffer
or incur as a result of personal information you provided to other
persons using the Flimo Website.
4. Disclosure upon Legal Requests
(a) Flimo cooperates with law enforcement inquiries and will disclose
your personal information as permitted or required by law in connection
with any investigation of fraud, intellectual property infringements,
piracy or other illegal activity.
(b) You hereby authorise Flimo to disclose your personal information
for the above purposes.
5. Your use of Other Users’ Information
(a) Flimo hereby grants you a licence to use other User’s personal
information obtained through our Website solely for the purpose of
transacting through the Flimo Website unless the other User consents
otherwise.
(b) You must not send unsolicited commercial messages to other User’s
email addresses obtained through the Flimo Website.
(c) You must not disclose Personal Information about another User
to any third party without Flimo’s consent and the consent of
the User.
(d) You must allow Users to review what information you have collected
about them and to remove themselves from your database.
6. Password
(a) Flimo strongly advises not to disclose your password to any third
parties.
(b) You are responsible for all actions undertaken with your Username
and Password including payment of Flimo’s fees.
(c) If your password is tampered with in any way, you should immediately

7. Changing Your Personal Information
(a) You may review and change your personal information submitted
to us by logging in HERE.
(b) You may de activate your membership by logging in HERE.
(c) We will retain in our records Personal Information you have requested
to be removed to comply with legal requirements.

limitations, however your Personal Information will be kept from public
viewing.
